Terms of NJAMITO Online Shop
(hereinafter: “terms”)

GENERAL:
These terms govern the sale of products available in the online store, the rights of the customer, and the business relationship between the provider and the customer.
These terms are valid with every visit or purchase in the online store, specifically when placing an order in the online store. Each version of the terms is separately dated. For each individual order, the terms published in the online store at the time of the order submission apply.
A user cannot place an order unless they have previously agreed to (and explicitly confirmed) the content of these terms, which are available at the following link: [insert link].
These terms are drafted in accordance with the requirements of European consumer protection, data protection laws, and other applicable legislation.
These terms are provided in such a manner that the customer can save and reproduce them.
DEFINITIONS
- online store – INACHI online store is the online store on the website njamito.com and is part of the company INACHI d.o.o., which manages the website and provides the customer with access to the selected online store to make their online purchase;
- provider – INACHI, raziskave in razvoj, d.o.o., Vilharjeva cesta 3, 1000 Ljubljana, Slovenia;
- product(s) – any of the NJAMITO products in the online store, in different flavors and with features as listed in the online store. Products in the online store can only be purchased in a package of four (4) products, i.e., as a bundled product;
- customer – a natural or legal person who purchases products from the provider’s assortment in the online store;
- registered user – a customer who, in accordance with these terms, obtains a username and sets a password in the online store, thereby becoming a registered user and gaining access to certain additional benefits;
- consumer – a natural person who acquires or uses goods, services, and digital content for purposes outside of their professional or business activities;
- legal entity – an organizational formation that has been granted legal capacity under the legal system, and persons registered in the business register as sole proprietors and other natural persons who conduct business activities;
- personal data – any information relating to an identified or identifiable individual;
- online price – the price applicable online. Any special/lower prices may be specifically marked in the online store.
ORDER AND CONCLUSION OF THE SALES CONTRACT
Registration. In the online store, customers can make purchases as a registered user or without registration.
When purchasing in the online store, the customer has the option to register by obtaining a username in the form of their email address and setting a password. The password is known only to the registered user, who must ensure that they, or a person authorized to act on their behalf, use it. By registering, the customer gains certain benefits as a registered user, including:
- Access to digital services on various devices
- Managing business dealings with the provider in one place
- Ability to review and manage their orders, including order history.
Products. All products listed in the online store are available until stocks are sold out.
The provider strives to provide clear, comprehensive, and up-to-date information about the basic features of products, which are listed on the product packaging. The product you receive will include all mandatory information. We recommend that you always carefully read the information provided on the product packaging before use or consumption.
The provider strives to provide appropriate images for all products in the online store, but it should be noted that the images are symbolic and do not guarantee the product’s properties. In the case of aesthetic differences between the image and the actual product, this does not affect the specification of the product itself.
The provider reserves the right to make content and other changes in the online store without prior notice.
Order and conclusion of the sales contract.
The customer in the online store makes a purchase by adding or removing products from their shopping cart as desired.
The confirmation of the order by the customer includes the following steps:
- Verifying the type of products, quantity, and amounts of all ordered products in the shopping cart, and making any necessary changes to the order;
- Entering the required details for processing the order;
- Selecting the payment method; and
- By clicking on the „BUY“ button, submitting the order.
By clicking on „BUY,“ the customer:
- Confirms that they are, in accordance with the law, older than 18 years and that they have not been deprived of their legal capacity;
- Confirms that they are familiar with the entire text of the terms, which they fully accept, along with the processing of personal data in accordance with the Privacy Policy; and
- Concludes a sales contract (remotely) with the provider with an obligation to pay.
The provider will send the customer an order confirmation to the entered email address, which the customer agrees to and will consider as confirmation of the concluded sales contract on a durable medium. The order/contract is concluded in one of the following languages: English, Slovenian. The contract is concluded for a period until all contractual obligations are fulfilled, i.e., the delivery of the goods and the full payment of the purchase price.
Written proof of the order is stored electronically on the provider’s server and is available to the registered user at any time in their user profile, as well as free of charge upon request sent to one of the contact points listed in the „About the Company“ section above.
Errors in the personal details provided during the purchase process can be corrected upon request sent to one of the contact points listed in the „About the Company“ section above.
Only for legal entities: We advise legal entities to contact us at info@njamito.com. The process of concluding the sales contract and its terms (e.g., delivery, discounts, etc.) for customers who are legal entities may differ from the process for individual customers (consumers) and may be subject to additional agreements between INACHI and the respective legal entity.
COUPONS AND DISCOUNTS
In the online store, you can use a coupon code that you have received through various promotional activities. The received coupon will be applied as a discount on the product price (which reduces the final amount to be paid, hereinafter referred to as „coupon„).
You can redeem the coupon during the purchase process at the checkout by entering the received coupon in the designated field.
Each coupon can be used only once, always with the validity of that coupon in mind. Only one coupon can be applied per order. Some coupons may not be applicable for purchasing discounted products. A coupon may only be valid for purchasing specific products and/or for a certain minimum order value or minimum number of products.
If you return the products, we reserve the right not to extend the validity of the coupon.
ONLINE PRICES
All prices in the online store are stated in euros and already include Value Added Tax (VAT), unless explicitly stated otherwise.
Shipping costs are not included in the product prices and are displayed separately to the customer under the „Shipping“ section before submitting the order. The prices are presented as online prices.
The purchase price is charged in a single installment according to the online prices valid at the time the order is placed, or the valid prices are those online prices that were in effect when the provider’s information system received the order, taking into account any discounts (coupon, etc.).
PAYMENT AND INVOICE
The provider in the online store allows the following payment methods:
- By credit card: Mastercard, Visa, etc., via the Stripe Inc. platform or PayPal
- Cash on delivery (only for legal entities)
The online order form filled out by the customer when placing an order does not serve as an invoice. Regardless of the type of purchase or payment method, the invoice will be sent to the customer by email.
RIGHT TO REJECT THE ORDER
The provider reserves the right to partially or fully cancel the order, particularly in the following cases:
- If the customer has outstanding obligations to the provider,
- If an error is detected in the product description or price,
- If the customer causes business damage to the provider in any way (e.g., repeated ordering and canceling of orders, etc.),
- If the order was not completed or correctly filled out, and the customer does not resolve identified risks or deficiencies within the additional time given,
- If the authorization for payment execution by the bank is not confirmed, making the payment impossible,
- If the provider receives notification from the bank or a state authority regarding credit card fraud or any other form of fraud that necessitates canceling the order,
- If the ordered product is no longer in stock.
In some cases, a product may be sold out due to high demand. In such cases, we will inform you immediately after receiving the order, remove the value of the product from your account, and discuss alternative options.
If the flavor of the product you ordered is sold out, we will notify you immediately and, if possible, offer a substitute product with a different flavor. The substitute product will be sent to you only if you explicitly agree to it.
DELIVERY
We deliver products throughout Austria!
Standard delivery across Austria is carried out from Monday to Wednesday (except on public holidays and non-working days in Slovenia). All orders placed on Wednesday after 1:00 PM or later in the current week will be shipped on Monday of the following week (or on the next working day if Monday is a public holiday or non-working day in Slovenia).
Due to changes with the delivery service, unforeseen traffic conditions, and similar inconveniences, there may be temporary changes in the delivery time, and we will try to keep you informed in a timely manner.
Delivery Costs:
The delivery cost is shown during the online purchase process before submitting the order.
How do you know when you will receive the product?
On the day the package leaves our shipping center, the courier service will notify you about the status of the package.
What if you are not home / in the office?
We strive to notify you as accurately as possible about the delivery date and time via email and phone number so that you can plan to receive the package. Njamito is not heat-treated because we didn’t want to compromise on taste and vitamins. This means that we cannot wait for you during delivery. If you are not at the address you provided when placing the order, and the delivery service leaves the product at the door or another location, or in a parcel locker, the product is considered correctly delivered and accepted. At this point, the responsibility for storing the product according to the conditions on the packaging and for the quality of the product transfers to the customer.
RIGHT TO WITHDRAW FROM THE CONTRACT AND RETURN OF GOODS/PAYMENT
The customer has the right to withdraw from the contract within 14 days from the date of receipt of the goods, without stating the reasons for their decision. The withdrawal period expires 14 days from the day the customer takes actual possession of the goods, or a third party,designated by the customer (who is not the carrier), takes possession of the goods.
To ensure that the withdrawal period is observed, the customer needs to send a statement of withdrawal before the withdrawal period expires.
A clear statement of withdrawal, which should include at least the following information: date, name and surname of the customer, their address, details of the product and order concerned, date of the order, date of delivery, contact details of the customer (telephone number or email address), and bank account details if the customer wishes to receive a refund by bank transfer, can be sent by the customer by post to: INACHI d.o.o., Vilharjeva cesta 3, 1000 Ljubljana, Slovenia, or to the email address: info@inachi.si.
The return of the received goods to the provider within the withdrawal period will be considered as a statement of withdrawal.
The customer is responsible for the costs of returning the goods. The goods must be returned to the provider no later than 14 days from the letter of withdrawal. The customer must return the goods to: Inachi d.o.o., Vilharjeva cesta 3, 1000 Ljubljana, Slovenia, by post. The products should be appropriately prepared for transport (original packaging or other suitable protective packaging may be used). We recommend using a courier service that allows tracking of the shipment. To ensure the proper quality of the products, the cold chain must remain uninterrupted during the return and delivery of the products. Otherwise, the provider reserves the right to refuse the return and retain the payment.
The goods must be returned in the condition in which they were delivered to the customer or to the designated recipient. If the customer returns goods that are visibly used or damaged, in reduced quantity, or otherwise unsuitable for use according to the provider’s activity, they are still obligated to pay the purchase price for those goods. Used or damaged goods, for which the customer’s right to withdraw does not apply, include (i) products whose packaging has been opened (including the opening and/or damaging of the seal), as these are not suitable for return for health or hygiene reasons, or (ii) if the customer has not ensured the appropriate cold chain or storage in accordance with the conditions on the packaging. Before the return, the provider may also require current photographs of the product to prove the proper condition of the product.
If the customer withdraws from the contract, the provider will refund all payments received without undue delay and no later than 14 days from the day the provider receives the statement of withdrawal. The refund will be made using the same payment method as used in the original transaction, unless agreed otherwise (if the customer specifies another payment method), or if the nature of the payment prevents a refund via the same method. The provider has the right to withhold the refund until the goods are returned or until the customer provides proof that the goods have been sent back.
According to applicable legislation, the customer does not have the right to withdraw from the contract (among other cases) in the following instances:
- In the sale of food, beverages, or other goods intended for everyday use and regularly and frequently delivered to the customer’s home, residence, or workplace;
- For products that, due to their nature, are not suitable for return, are perishable, or have already passed their expiration date;
- If the total amount of payments the customer has to make under the contract does not exceed 50 euros.
If the customer withdraws from the purchase of a bundled product (multiple products in one package), and does not return all the products in the package within the legal deadline or does not return them in appropriate condition for return (as described in these terms), the provider is entitled to charge the customer the full retail price of those products at the time of purchase.
The rights in this chapter (RIGHT TO WITHDRAW FROM THE CONTRACT AND RETURN OF GOODS/PAYMENTS) apply only to customers who are considered consumers.
RESPONSIBILITY OF THE PROVIDER FOR NON-CONFORMING GOODS
Information on any additional warranties and their specific terms can be found on the product and in the online store. Legal provisions regarding liability for defects apply.
If you notice a non-conformity with the goods, such as a damaged, broken, or opened product, if the product is different from what you ordered, or if it arrives in a quantity smaller or larger than ordered, please immediately notify us via one of the contact methods listed in the „About the Company“ section above.
In these cases, please keep the package, products, and packaging, and take photographs (of the labels, external packaging, and products). Please send these photos along with a brief explanation and a copy of the invoice.
The rights in this chapter (RESPONSIBILITY OF THE PROVIDER FOR NON-CONFORMING GOODS) apply only to customers who are considered consumers.
WARNINGS AND LIMITATIONS
To protect against abuse of payment and credit card information, the provider may verify the information related to the customer’s order.
The provider does not accept any responsibility and cannot be held liable for any malfunctions of hardware or software or other property, as well as any potential virus infections that may affect the equipment of the registered user or customer due to visiting the online store, transferring data, photos, video and audio recordings, or other published content.
The website njamito.com may contain links to third-party websites and/or information about third parties. The provider is not responsible for the content or operation of these websites.
The registered user and customer are solely responsible for safeguarding their user information and password. They also guarantee the accuracy and truthfulness of all information provided during registration and ordering, and are liable to the provider for any potential damages arising from inaccurate or false data.
PERSONAL DATA
The provider collects, processes, and protects personal data in accordance with applicable laws governing the protection of personal data, these terms, the Cookie Policy, and the Privacy Policy (which can be accessed at: [add link]).
The processing of customer personal data may take place based on one of the following legal grounds: explicit consent, an existing contractual relationship, or legal obligations that bind us as the data controller. The customer has the right to withdraw consent for the processing of their personal data at any time, request access to their personal data, correction, deletion, restriction of processing, transfer, or object to the processing. Any requests can be sent to the provider at any time via the contact details provided in the „About the Company“ section above.
If the customer believes that there has been a violation of the legislation regarding the processing of their personal data, they can file a complaint with the Information Commissioner. More details can be found in the privacy policy published on our website: [add link].

SECURE ONLINE SHOPPING
The website for ordering products and transfers is protected and appropriately secured both technically and electronically.
The provider commits to taking all reasonable security measures to ensure the safety of all payment data during the customer’s order process. The provider is not responsible for any potential data theft, except in the case of gross negligence on the part of the provider.
COMPLAINTS AND DISPUTES
The provider respects the applicable consumer protection laws and strives to establish an effective complaint handling system. In accordance with applicable law, the provider declares that it is not a signatory to any code of conduct.

The complaint handling process is confidential. The provider endeavors, to the best of its ability, to resolve any disputes amicably and to respond to all complaints as quickly as possible.
